Attorney General DeWine Seeks Consumer Restitution from Mobile Home Mover

(NEW LEXINGTON, Ohio)—Ohio Attorney General DeWine today announced a lawsuit against a Somerset man accused of failing to deliver promised mobile-home moving services to Ohio consumers.

The lawsuit accuses David Lee Marsh, Sr., doing business as David’s Mobile Home Transport and Repair, of violating Ohio’s Consumer Sales Practices Act.

“Despite our efforts to resolve these issues out of court, some consumers still have not received refunds for services they paid for but never received as promised," Attorney General DeWine said. "We are seeking an end to the violations and restitution for affected consumers."

David Marsh is the owner and operator of David’s Mobile Home Transport and Repair, which provides mobile home transport, mobile home repair, and site preparation services in Ohio.

At least 10 consumers have filed complaints against the business with the Ohio Attorney General’s Office or the Better Business Bureau. While some complaints have been resolved, others have not, and total estimated consumer loss is more than $12,000.

In their complaints, consumers said the supplier failed to start the work during the scheduled time period, performed shoddy work, or failed to complete the job.

Filed in the Perry County Court of Common Pleas, the Attorney General’s lawsuit alleges violations of Ohio’s Consumer Sales Practices Act. Specific counts include failure to deliver promised services and performing shoddy work without correcting it.  In the lawsuit, the Attorney General seeks a declaration that these acts violate the Consumer Sales Practices Act, an end to further violations, consumer restitution, and civil penalties.

Attorney General DeWine encourages consumers to research a business before entering into a contract with the business or providing any payment. Consumers can review complaints filed with the Ohio Attorney General's Office or Better Business Bureau, talk to past customers, and obtain written estimates from several businesses before making a final decision.
