Attorney General Yost Seeks Reimbursement from Used Car Seller over Title Problems

3/4/2019

(LIMA, Ohio) – Ohio Attorney General Dave Yost today announced a consumer protection lawsuit against a used car dealership and its owner accused of failing to deliver vehicle titles to consumers in northwest Ohio.

The lawsuit accuses Budget Motors & RV Sales LLC and Michael Stevens, its owner and operator, of violating Ohio consumer protection laws. According to the lawsuit, the dealership last operated at 115 West Kiracofe Ave. in Elida.

Two consumer complaints were filed against the dealership, with consumers alleging they never received the titles to vehicles they bought from Budget Motors & RV Sales. The Ohio Attorney General’s Consumer Protection Section worked to resolve the complaints, in both cases making payments from the Title Defect Recision Fund - a program that helps used car buyers resolve certain title problems - to the consumers who could not obtain their titles.

“Thousands of Ohio consumers contact our office each year asking for help and used car sales is the category with the most complaints,” said Yost. “Consumers often have to wait and save up their money to make this kind of major purchase. When the person they’re buying from doesn’t follow the rules, we’re going to step in to help just as we did here. There are many trustworthy used car dealers out there. It pays to be an educated consumer.”

The Attorney General’s lawsuit, filed in the Allen County Court of Common Pleas, seeks to recover more than $8,000 that was paid from the Fund in the case. It also seeks reimbursement for affected consumers, an order prohibiting further violations of Ohio’s consumer protection laws, civil penalties, and other relief as the Court deems appropriate.

Consumers who suspect an unfair or deceptive sales practice should contact the Ohio Attorney General’s Office at www.OhioProtects.org or 800-282-0515.
