The Tobacco Enforcement Unit enforces the Tobacco Master Settlement Agreement (MSA) between the state and participating tobacco manufacturers, represents the Ohio Department of Health in matters related to smoking ban laws, and represents the two major recipients of Ohio tobacco settlement dollars, the Third Frontier Commission and the Southern Ohio Agricultural Development and Community Foundation.
In November 1998, Ohio and 45 other states and U.S. territories signed the MSA with the primary tobacco manufacturers. The agreement has both economic and public health benefits and requires participating manufacturers to make an ongoing annual payment to the settlement states. Ohio is the fourth-largest recipient of MSA dollars.
Ohioans voted in 2006 to ban smoking in most public places and places of employment. In the past year, the Tobacco Enforcement Section defends the imposition of fines for violations of the Smoke Free Act in administrative hearings and administrative appeals in the Franklin County Court of Common Pleas and the Tenth District Court of Appeals.
