Construction Contracts and Checklists


Who should use these forms?

  • These construction contracts and Architect/Engineer forms are provided for state higher education clients with projects that are not being managed by the State Architect’s Office. 
  • The checklists are designed to streamline the Ohio Attorney General’s Office’s review of construction contracts, and to highlight the legal requirements applicable to state construction contracting. The checklists are available to all state clients that are not required to manage their projects through the State Architect’s Office.
  • These standard contracts were drafted with participation of the State Architect, the Attorney General’s Office, and many different stakeholders. They are constantly being reviewed for future improvement, and updates will continue to be posted to this web site.

What edits should a college or university make to these forms?

  • Only the contract language in blue should be filled in and/or edited as applicable. There should be no blue lettering or brackets in the final contract documents.
  • Please spell out all dollar amounts.
  • All A/E Agreements must include an Exhibit #1.

Modifications to the contract forms

  • If a state client wishes to modify the forms that are published by the State Architect’s Office, they must file Supplementary Instructions and/or Supplementary Conditions with the modifications.  All requests for filing Supplementary Instructions and/or Supplementary Conditions should be sent to the State Architect at: Lane.Beougher@das.state.oh.us

General Contracting


As part of the recent budget bill, general contracting is now permissible as an option for state entities that prefer it to the use of multiple prime contractors.  The State Architect’s Office’s general contracting form has been tailored for higher education clients and is posted below.  Since the use of multiple prime contractors is still permitted, those contracts have been tailored and posted below as well.  It should be noted that if you choose to use the general contracting method, there is a mandatory subcontract form which is available from the State Architect’s website at http://das.ohio.gov/LinkClick.aspx?fileticket=geZQedxMolY%3d&tabid=363
