ARBITRATION

Bozich v. Kozusko (Lorain Cty), 2009-Ohio-6908, PIF 2824

The Court of Appeals upheld the trial court's decision staying litigation and compelling arbitration. As the trial court had found the provision of the inspection contract that limited liability to the cost of the inspection was unenforceable, the Court held that the Plaintiff's had failed to demonstrate that the arbitration clause, standing on its own, was substantively unconscionable. The Court found that the rules governing the arbitration, unlike those in the Eagle case, did not violate the public policy goals of the CSPA.
