Appeals

The Appeals Section represents the state of Ohio and its agencies on appeals in the U.S. Supreme Court, the U.S. Court of Appeals for the Sixth Circuit and the Ohio Supreme Court.

The section handles a wide range of cases, from civil rights to election disputes to criminal law and more. Headed by the Ohio Solicitor General, this section determines the cases in which the state of Ohio will seek U.S. or Ohio Supreme Court review and the positions the state will take before those courts. The Solicitor General and deputy solicitors prepare the petitions, briefs and other papers filed by the state on appeal. They also regularly participate in oral arguments before those courts.

Amicus Support:

The Attorney General’s Office provides a wide array of services and tools to support the important work of law enforcement and prosecutors. The Attorney General often supports the legal positions of others by filing amicus briefs. 
 
In Williams v. Illinois, now pending in the U.S. Supreme Court, Ohio led 43 other states and territories in support of Illinois’s efforts to preserve for prosecutors the use of expert witness testimony about forensic evidence in criminal trials. 
 
In State v. Carlisle, the Attorney General’s Office supported Cuyahoga County in persuading the Ohio Supreme Court that trial courts are not empowered to modify a criminal sentence after final judgment. The Court sided with Cuyahoga County in December.
